PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION THAT AFFECTS YOUR RIGHTS, REMEDIES, AND OBLIGATIONS. THEY INCLUDE AN AGREEMENT TO ARBITRATE (UNLESS YOU OPT OUT). THESE TERMS ALSO INCLUDE A PROHIBITION OF CLASS AND REPRESENTATIVE ACTIONS AND NON-INDIVIDUALIZED RELIEF FOR ALL MATTERS IN EITHER COURT OR ARBITRATION, VARIOUS LIMITATIONS AND EXCLUSIONS, A CLAUSE THAT GOVERNS THE JURISDICTION, VENUE, AND GOVERNING LAW OF DISPUTES, EXCEPT WHERE PROHIBITED, AND OBLIGATIONS TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS.
Welcome to DriveMobi Inc. ("Mobi," "we," or "us"). Mobi operates an online carsharing platform that connects vehicle owners (“hosts”) with individuals (“guests”)—whether locals, travelers, or gig workers—looking to rent vehicles. Our platform is available through our website at drivemobi.com, as well as through related digital services and features (collectively, the “Services”).
By accessing or using any part of the Services—including browsing our website, creating an account, communicating with other users, or booking a vehicle—you agree to these Terms of Service (the “Terms”), regardless of whether you become a registered user. These Terms form a binding legal agreement between you and Mobi.
In addition to these Terms, your use of the platform is governed by our other applicable policies we publish (collectively, the “Policies”). Together, these documents make up your full agreement with Mobi (the “Agreement”).
Each reservation made through Mobi is also subject to a Car Sharing Agreement, which outlines the terms agreed upon between the host and renter at the time of booking.
Mobi acts solely as a facilitator of vehicle sharing transactions between guests and hosts. We are not a party to the vehicle rental itself; instead, we enable the connection, agreement, and payment between users of the platform.
If you don’t agree with any updates, your option is to stop using the Services and close your account within 30 days of the changes. If you close your account within that period and don’t access the platform during that time, the previous version of the Terms will remain applicable to you. However, if you continue using the Services, the new Terms will apply.
Mobi is a platform built for responsible drivers and vehicle owners. To use the Services:
Guests must be at least 21 years old and meet all eligibility criteria established by Mobi.
Hosts must be at least 21 years old, and any vehicles they list must fully comply with Mobi’s vehicle eligibility requirements.
Use of the Services by anyone who doesn’t meet these requirements is not permitted.
To access key features of Mobi, you’ll need to create a Mobi Account. This involves providing basic information such as:
First and last name as it appears on your driver’s license
Email address
Mobile number
A password (or connecting through third-party logins like Apple or Google)
Additional details will be required depending on whether you’re booking a trip or listing a vehicle. This includes personal verification information for guests and vehicle-related info for hosts.
You agree to provide accurate, current, and complete information during the signup and onboarding process—and to keep your Mobi Account updated at all times. Based on the information you provide, Mobi may apply additional requirements (such as a security deposit, a second payment method, or selecting a specific protection plan) before allowing you to book or list.
Mobi may—but is not obligated to—conduct identity checks, driving record reviews, and vehicle verification processes to help maintain a safe and trustworthy platform.
This may include:
Verifying your driver's license and driving history
Confirming your identity and submitted details
Validating your vehicle’s eligibility, title status, and legal compliance
We may work with trusted third-party partners to help carry out these checks. By using Mobi, you authorize us to request, receive, and store information relevant to these verifications.
Mobi does not guarantee or endorse any vehicle, driver, or user based on these processes. It is the host’s responsibility to ensure their vehicle is:
Safe and operable
Legally registered for road use
Free of any salvage, branded, or written-off titles
Not under recall unless properly addressed
Fully compliant with Mobi’s vehicle eligibility standards
By attempting to book or list a vehicle—or if Mobi reasonably believes your account poses an increased level of risk—you authorize Mobi to obtain consumer reports where legally allowed.
This may include:
Personal or business auto insurance scores
Credit reports
Criminal background checks (where permitted)
You provide this authorization in compliance with the Fair Credit Reporting Act and other applicable consumer reporting laws.
Mobi’s fees and costs are transparently displayed during checkout for guests. You’ll always have a chance to review the full breakdown before confirming your trip.
By adding a payment method to your Mobi account, you authorize Mobi and our third-party payment providers to securely store your credentials for future use—whether for trip costs, service fees, extensions, late charges, security deposits, or claims-related fees.
Some payment processors automatically update saved card details (e.g., when a card expires or is replaced), and we may rely on these updates to process outstanding balances.
If a refund is due and your original payment method is no longer available, Mobi reserves the right to issue travel credit instead.
Mobi may also issue promo codes from time to time—these are subject to the specific terms of the offer and any applicable platform policies.
If you owe any amount to Mobi, we (or our service providers) may pursue all legal means to recover it. This includes involving collection agencies or legal counsel. Delinquent payments may also be reported to credit bureaus, which can affect your credit score.
If your account becomes delinquent or you issue a chargeback, you may be responsible for additional costs related to collection efforts, including service and convenience fees.
To dispute a report made by Mobi to a credit bureau (e.g., Experian, Equifax, or TransUnion), please contact Mobi Support.
To dispute a report made by a collection agency, please contact that agency directly.
In some regions, Mobi may be required to collect and remit taxes (such as sales tax, usage fees, or carsharing-specific levies) on behalf of guests or hosts, in accordance with applicable laws and marketplace facilitator regulations.
When taxes are collected by Mobi:
The amounts will be clearly shown in your receipts and trip documents.
Hosts may not collect the same taxes separately within those jurisdictions.
Mobi also complies with reporting regulations which require us to report gross earnings (total income before deductions) to tax authorities on an annual basis. By using Mobi, you consent to receive tax documents electronically.
By using Mobi, you agree to follow these Terms, all applicable laws, and any additional policies or standards we share with you.
You are solely responsible for all activity that occurs under your Mobi Account. Please keep your login credentials—especially your password—secure and confidential.
Do not share your password with anyone.
Monitor your account regularly for any suspicious activity.
If you suspect unauthorized access or use, notify Mobi immediately.
Mobi is not liable for any losses or damages resulting from your failure to secure your account or for delays in reporting unauthorized access.
As long as you comply with these Terms, Mobi grants you a limited, revocable, non-exclusive, non-transferable license to access and view content on the platform—whether created by Mobi or by other users—strictly for personal, non-commercial use.
This license does not grant you the right to sublicense, reproduce, or use any Mobi or user content beyond what is explicitly allowed. No additional rights are granted to you under Mobi’s or its partners' intellectual property unless clearly stated in these Terms.
You may have the opportunity to upload or share content through the Mobi platform—such as vehicle photos, trip reviews, host bios, or feedback.
By submitting any content to or through Mobi (including content used in Mobi campaigns or promotions), you grant Mobi a worldwide, royalty-free, perpetual, non-exclusive, and transferable license, with the right to sublicense, to:
Use
Copy
Modify
Distribute
Display
Perform
Stream
Promote
And otherwise exploit your content across the platform or in marketing efforts
Unless otherwise noted (e.g., with Mobi-provided photography), you retain ownership of your content. Nothing in these Terms restricts your rights to use it elsewhere.
Mobi respects intellectual property rights and responds to valid notices of alleged copyright infringement. We may suspend or terminate the accounts of users who repeatedly infringe others’ rights.
Mobi integrates Google Maps/Places APIs and uses Google’s reCAPTCHA Enterprise to protect the platform from fraud and abuse. By using Mobi, you agree to be bound by Google’s Terms of Service.
When using Mobi, you agree to operate with integrity and respect for others—and you may not, under any circumstance, engage in activities that violate our terms, harm our users, or disrupt the platform. This includes encouraging, assisting, or enabling others to do so. Users who violate these Terms will be strictly and permanently removed from the Mobi platform. We enforce this without exception.
You may not:
Use Mobi to find a host or guest, then complete the transaction off-platform (aka “gray market” transactions).
Transfer your Mobi Account or user ID to someone else without our written consent.
Fail to deliver or return vehicles and Extras on time without valid reason.
Leave a vehicle running or unlocked unless explicitly instructed by Mobi.
You may not:
Break any local, state, provincial, or national law—including airport rules, tax regulations, licensing requirements, or court orders.
Post false, misleading, defamatory, or libelous content.
Infringe on copyrights, trademarks, or other IP or proprietary rights unless you have written permission.
You may not:
Provide false or misleading information (e.g., name, date of birth, driver’s license, payment method, insurance).
Impersonate someone else or misrepresent your affiliation with any person or organization.
File false claims or engage in fraudulent behavior related to bookings, vehicle use, or trip disputes.
You may not:
Harass, stalk, threaten, or abuse other users—verbally or physically.
Collect or store another user’s personal data for non-transactional purposes.
Share photos or personal details of others without permission.
Discriminate based on race, gender, religion, age, disability, sexual orientation, or identity. Discrimination is not tolerated on Mobi.
Bring legal claims against Mobi or other users in violation of these Terms.
You may not:
Contact users for anything unrelated to bookings or use of Mobi.
Solicit users to join other platforms or services that compete with Mobi.
Commercialize Mobi’s content or software (including user reviews) without permission.
Harvest or scrape user data or conduct unauthorized background checks.
You may not:
Interfere with or manipulate other users' listings.
Send spam or unsolicited commercial content.
Spread malware, viruses, or use bots, scripts, crawlers, or scraping tools to access or disrupt Mobi.
Overload our infrastructure or bypass system protections like robot exclusion headers.
Frame, copy, or mirror any Mobi page, feature, or brand assets without written approval.
Tamper with non-public systems, networks, or security protocols.
Probe for vulnerabilities, bypass authentication, or reverse engineer any part of the platform.
You may not:
Attempt to circumvent account suspensions, bans, or closures (including by creating new accounts or listing under someone else’s name).
Violations of these rules may result in suspension or permanent removal from Mobi, legal action, and liability for damages. Let’s keep Mobi safe, fair, and trustworthy for everyone.
Mobi reserves the right—but not the obligation—to investigate, enforce, and, where appropriate, escalate violations of our Terms and Policies to the fullest extent permitted by law. This may include referring cases to law enforcement or pursuing civil action.
We may remove or restrict access to any content that, in Mobi’s sole discretion, is harmful, violates our Terms, or goes against the spirit of our community—without prior notice and as allowed under applicable law.
If we believe you are misusing the platform, harming others, or violating Mobi’s rules, we may take any combination of the following actions, at our discretion:
Suspend or terminate your Mobi Account
Remove or demote your listings
Deny claims or withhold funds
Adjust or revoke discounts or promotions
Apply technical restrictions to prevent platform access
We also reserve the right to limit or remove listings that are priced significantly above market rates or—where applicable—if cancellation activity violates platform policy.
When applying policies, Mobi may consider a user’s past behavior, intent, and the context of the situation. We reserve the right to offer flexibility in enforcement where we believe it’s the right thing to do. This judgment is made at Mobi’s sole discretion.
By using Mobi, you consent to receiving communications from us electronically—whether via email, in-app notifications, or text messages.
To better serve you, we may also contact you via auto-dialed calls or text messages regarding:
Account verification or activity
Fraud prevention or account security
Unpaid balances or collections
Time-sensitive issues requiring your attention
Standard call and text rates may apply.
We may monitor or record calls and web chats with you (or someone on your behalf) for quality, training, or compliance purposes.
Mobi is not an insurance provider. The protection plans available to hosts and guests through the platform are facilitated via third-party insurance or risk-bearing partners. These plans are distinct for hosts and guests and operate independently.
To be eligible for any protection benefits, users must comply with these Terms and all related policies.
Please refer to the relevant Host or Guest Terms for specific details.
Vehicle Safety & Legal Compliance: Your vehicle must be safe, roadworthy, and legally registered and insured, with a clean (non-salvage/branded) title and valid license plates.
On-Time Availability: You agree to deliver or make the vehicle available on time to the approved driver listed in the reservation.
Data Privacy: Other than verifying the renter’s driver’s license, you will not collect personal information or insurance details from the guest. You may not use guest information for background checks or other data gathering.
Listing Accuracy: Your listings must be truthful and accurate. You must honor all booking terms, including pricing, vehicle availability, and description.
No Forced Upgrades or Cancellations: You will not cancel bookings to seek higher prices or require guests to accept costlier or different vehicles.
Ownership & Authorization: Only list vehicles you own or have full rights to share for compensation. If your vehicle is leased or financed, ensure sharing on Mobi does not violate your agreement.
No Stolen or Recalled Vehicles: You may not list vehicles that are reported stolen, under recall without resolution, or unfit for the road.
No Weapons: Firearms or other weapons must be removed before making a vehicle available for pickup.
Third-Party Account Access: If you direct Mobi to retrieve account information (e.g., from toll agencies), you grant Mobi limited power of attorney to do so as your agent.
Provide accurate details including license plate and VIN. Each vehicle must meet the requirements found here.
Only list vehicles you own or have full rights to share.
Disclose if your vehicle uses tracking devices or OEM technology (e.g., GPS, telematics, remote disabling). You must comply with Mobi’s requirements and applicable law regarding such devices.
Mobi owns or holds exclusive license rights to all resulting images.
You may only use these images on Mobi—not on other platforms.
Mobi may use these images in marketing, and you waive any claim to royalties or rights of publicity.
You must ensure the vehicle is available at the agreed time and location.
You are responsible for confirming the renter’s driver’s license is valid and matches the booking.
You must take clear photos of all four corners of the vehicle both before and after each trip. Incomplete or missing documentation may affect your ability to successfully file a damage claim
Payment processing is managed by Stripe, and by using Mobi, you agree to Stripe’s terms and authorize Mobi to facilitate transactions on your behalf.
Keep your vehicle in safe, working condition.
Address recalls and complete necessary maintenance.
Only list vehicles with a clean, non-branded title.
Remove your vehicle from the platform if Mobi finds it does not meet safety standards.

You authorize them to act on your behalf using Mobi tools.
You are responsible for their actions.
Mobi is not a party to any agreements between you and your Co-hosts and will not mediate related disputes.
Coverage provided includes:
Comprehensive and collision protection, with a $2,500 deductible per claim for hosts.
This protection applies only to vehicles valued at $55,000 or less. Vehicles exceeding this value are not permitted on Mobi. If a vehicle is listed in violation of this policy, it may be subject to a $5,000 deductible or may not be covered at all.
Auto liability coverage is provided at the minimum limits required by state law, including bodily injury and property damage liability.
By using Mobi, hosts and guests acknowledge and agree that all insurance-related services are provided by the insurance partner—and that Mobi has no role or responsibility in coverage determinations, claims processing, or dispute resolution. Refer to Host Insurance & Protection Coverage Policy.
By booking a vehicle through Mobi, you agree to:
Be a legally licensed driver and provide proof of a valid driver’s license.
Take good care of the vehicle and any Extras, and return both on time, in essentially the same condition as received.
Ensure that only Approved Drivers listed in your reservation operate the vehicle.
As the primary guest, you are financially responsible for any physical damage or theft of the vehicle during the trip, plus related costs. This applies regardless of who was at fault.
You may limit your out-of-pocket responsibility with Mobi’s protection plan in accordance with the insurance policy.
For trips in the US, third-party liability insurance is included. These policies are provided through Mobi’s insurance partners and are subject to regional terms and exclusions.
Use the vehicle only for personal or permitted commercial use approved by Mobi.
Do not access the vehicle before your scheduled start time and return it on time to the correct location.
Drive safely, wear seat belts, follow all local laws, and use child safety seats where applicable.
Do not leave the vehicle unlocked or keys unsecured.
Return the vehicle with a full tank, or at the same fuel level it had at the start of your trip. If not, you may be charged for the missing fuel plus a $10 convenience fee by the host.
If Mobi determines your use is unsafe or against policy, your trip may be terminated and the vehicle recovered.
Some vehicles may have devices that monitor usage (e.g., GPS, speed, fuel level, diagnostics). By using the vehicle, you consent to the collection and use of this data. You must inform all passengers and drivers about this monitoring.
You release and agree to indemnify the host and Mobi partners from liability arising from telematics device failure or misuse.
Hosts are responsible for keeping their vehicles legally registered, insured, and roadworthy. You must:
Inspect the vehicle at the start of your trip.
Report and photograph any pre-existing damage to avoid being held responsible.
If the vehicle appears unsafe, do not drive it—contact your host and Mobi immediately.
Mobi and hosts are not responsible for any personal belongings left in, lost from, or stolen from a vehicle.
If you’ve selected a protection plan and an incident occurs:
Report damage to your host and our third party insurance partner immediately.
Report collisions to local police as required.
Provide all necessary information and cooperate with the host and our claims partners.
Do not continue driving the vehicle after a major incident without Mobi’s explicit approval.
Mobi may report a vehicle as stolen if:
You don’t return the vehicle on time or fail to extend the reservation.
You return it to an incorrect location.
The vehicle or its components are stolen or damaged due to negligence (e.g., left unlocked).
You misrepresent or withhold key information.
Failure to return a vehicle may result in recovery costs, investigation fees, and law enforcement involvement. A $500 administration fee may apply.
Mobi or the host may repossess a vehicle if it is overdue, illegally parked, abandoned, or misused. If a vehicle goes missing:
Return the keys immediately.
File a police report within 12 hours of discovery.
Cooperate fully with Mobi, the host, and authorities.
This document outlines the guest-specific terms and responsibilities. By booking on Mobi, you acknowledge and agree to comply with these conditions.
You may stop using the Mobi platform at any time. Likewise, Mobi reserves the right to terminate your access, remove listings, or deactivate your account at any time and for any reason allowed under applicable law. Termination does not release either party from obligations already incurred, and Mobi may retain and continue using content (e.g., photos) you previously provided. Disclaimers, limitations of liability, legal dispute terms, and fee-related obligations will remain enforceable even after termination.
Listing or booking a vehicle on Mobi does not constitute a transfer or assignment of ownership or rights to the vehicle.
Mobi provides a platform to connect hosts and guests for carsharing. Mobi is not a rental car company or insurer and is not responsible for user behavior, vehicle issues, manufacturer defects, or third-party service providers. The platform is provided “as is” without warranties—express or implied—including those related to merchantability, fitness for a particular purpose, or non-infringement. Mobi does not guarantee uninterrupted service or the accuracy, reliability, or quality of listings, vehicles, or content.
To the fullest extent permitted by law, you waive all rights to hold Mobi or its affiliates (the “Mobi Parties”) liable for:
Vehicle availability or mechanical issues
Warranty or licensing problems
Third-party value assessments
Actions or omissions of other users
Mobi is not liable for indirect or consequential damages, including lost profits, business interruption, or system failures.
You also waive your rights to make claims against other users related to your use of the Services and expressly waive California Civil Code §1542 or any equivalent statute.
You agree to defend, indemnify, and hold harmless Mobi, its affiliates, and representatives from any claims or damages arising from:
Your use of the Services
Your violation of these Terms
Your interactions with other users
Your listings or bookings
This includes injuries, losses, and legal costs tied to shared vehicles or Extras.
Certain breaches are difficult to quantify and may result in liquidated damages of $5,500 per occurrence. These include:
Circumventing the platform (gray market transactions)
Misusing Mobi’s brand or trademarks
Unauthorized legal action
Hosting vehicles without proper registration or in unsafe condition
Circumventing account suspensions or enforcement
This fee reflects a reasonable estimate of losses and is enforceable to the extent allowed by law.
Mobi is not a traditional rental agency. It does not own or lease vehicles. Mobi simply connects hosts and guests through its online platform.
Mobi may round charges to the nearest whole unit of currency. Currency is based on the vehicle or search location.

If these Terms are translated, the English version prevails unless required otherwise by law (e.g., French consumers).
If any part of these Terms is held invalid, the rest remains enforceable. A delay or failure to enforce any term is not a waiver of that or any other term.
These Terms do not create a partnership, employment, or agency relationship between you and Mobi. You cannot make commitments on Mobi’s behalf.
These Terms represent the full agreement between you and Mobi. You may not assign rights or delegate obligations without written consent. Only a Mobi officer may approve changes to this agreement in writing.
