Mobi (Drivemobi, Inc.) Peer-to-Peer Vehicle Sharing Agreement, Liability Program and Vehicle Protection Plan Terms

Effective Date:8/01/2026

Last Updated: 8/25/2026

IMPORTANT NOTICE

PLEASE READ THESE TERMS CAREFULLY.

THESE TERMS GOVERN YOUR USE OF VEHICLES MADE AVAILABLE THROUGH THE MOBI PEER-TO-PEER VEHICLE SHARING PLATFORM AND ESTABLISH THE RIGHTS AND RESPONSIBILITIES OF VEHICLE OWNERS, GUESTS, AND MOBI.

THESE TERMS ALSO DESCRIBE:

  1. THE PERIOD DURING WHICH A GUEST IS AUTHORIZED TO POSSESS AND OPERATE A VEHICLE;

  2. THE MOTOR VEHICLE LIABILITY INSURANCE PROGRAM THAT MAY APPLY DURING THAT PERIOD; AND

  3. THE MOBI VEHICLE PROTECTION PLAN, WHICH PROVIDES CONTRACTUAL PROTECTION FOR CERTAIN PHYSICAL LOSS OF OR DAMAGE TO A SHARED HOST VEHICLE.

THE MOBI VEHICLE PROTECTION PLAN IS A CONTRACTUAL PROTECTION PROGRAM AND IS NOT A MOTOR VEHICLE INSURANCE POLICY. IT DOES NOT PROVIDE THIRD-PARTY LIABILITY INSURANCE, AND IT DOES NOT REPLACE OR MODIFY ANY MOTOR VEHICLE LIABILITY INSURANCE POLICY.

INSURANCE COVERAGE IS SUBJECT TO THE TERMS, CONDITIONS, LIMITS, AND EXCLUSIONS OF THE APPLICABLE INSURANCE POLICY PROVIDED BY TEQMOBILITY. WHERE THESE TERMS CONFLICT WITH THE TERMS OF AN APPLICABLE INSURANCE POLICY OR NON-WAIVABLE REQUIREMENT OF LAW, THE POLICY OR APPLICABLE LAW CONTROLS.

1. INTRODUCTION AND PURPOSE

1.1 The Mobi Platform

Mobi operates a peer-to-peer vehicle sharing platform that connects vehicle owners with individuals seeking temporary access to vehicles.

Through the Platform, an eligible vehicle owner (“Host”) may make a vehicle available for sharing, and an eligible driver (“Guest”) may request and receive authorization to use that vehicle for a specified period and purpose.

Mobi may provide administrative, technology, payment, verification, claims administration, customer support, insurance administration, and vehicle protection services in connection with the sharing transaction.

Mobi is not the owner of every vehicle made available through the Platform and, except where expressly stated otherwise, does not take title to or ownership of a shared vehicle merely because the vehicle is listed on the Platform. Mobi does not own, control, maintain vehicles made available through the Platform.

1.2 Peer-to-Peer Vehicle Sharing

For vehicles and rentals categorized as carsharing vehicles, transactions conducted through the Platform constitute peer-to-peer vehicle sharing and not traditional retail car rental.

The terms “Host” and “Guest” used in these Terms are intended to describe the parties to a peer-to-peer vehicle sharing transaction and do not, solely by virtue of participation in the Platform, create a traditional rental-car relationship.

1.3 Agreement Between Owner, Guest, and Mobi

These Terms form the governing car sharing program agreement applicable to:

  • Mobi;

  • each Owner (“Host”);

  • each Renter & Authorized Driver (“Guest”);

  • and

  • each Booking conducted through the Platform.

By creating an account, listing a Vehicle, accepting a Booking, or using a Vehicle through the Platform, you agree to comply with these Terms.

2. DEFINITIONS

The following definitions apply throughout these Terms unless the context clearly requires otherwise.

2.1 “Booking”

Booking means a reservation for the use of a specific Vehicle through the Platform that has been accepted or otherwise confirmed by Mobi.

A Booking may include:

  • the Vehicle;

  • the Host;

  • the Guest;

  • the Scheduled Start Time;

  • the Scheduled End Time;

  • the pickup location

  • the return location;

  • applicable fees;

  • the selected Protection Plan;

  • mileage or geographic restrictions;

  • and any other conditions applicable to the transaction.

2.2 Booking “Guest”

Guest means the individual identified in the Booking as the person authorized to receive possession and operate the Vehicle.

The Booking Guest must:

  1. maintain an active Mobi account;

  2. satisfy Mobi’s identity and eligibility requirements;

  3. possess a valid driver’s license appropriate for the Vehicle;

  4. satisfy applicable age and driver requirements;

  5. comply with these Terms;

  6. comply with the Booking requirements; and

  7. be authorized to operate the Vehicle during the Trip Period.

A person who merely creates an account, makes an inquiry, or is a passenger in a Vehicle is not a Booking Guest unless identified as such in the Booking.

2.3 “Authorized Driver”

Authorized Driver means the Booking Guest or another individual expressly approved by Mobi and authorized under the Booking to operate the Vehicle.

No individual other than an Authorized Driver may operate the Vehicle under any circumstances unless authorized by and through the Mobi platform.

The Owner may not independently authorize an additional driver unless Mobi’s Platform expressly permits that authorization and the individual satisfies Mobi’s applicable driver requirements.

2.4 “Host”

Host (listed vehicle owner) means the registered owner of a Vehicle made available for sharing through the Platform or another person legally authorized to make the Vehicle available for peer-to-peer vehicle sharing.

The Host represents that the Host (listed vehicle owner) has the legal right and authority to make the Vehicle available through Mobi.

2.5 “Vehicle”

Vehicle means a motor vehicle approved by Mobi and made available for sharing through the Platform.

A Vehicle must satisfy Mobi’s applicable eligibility requirements throughout the period in which it is listed.

Mobi may establish eligibility requirements relating to:

  • age;

  • make;

  • model;

  • condition;

  • mileage;

  • title status;

  • registration;

  • safety;

  • inspection;

  • recalls;

  • insurance;

  • geographic location;

  • vehicle use;

  • and other risk characteristics.

2.6 “Platform”

Platform means the Mobi website, mobile application, software, communication systems, payment systems, vehicle-access technology, telematics systems, and related services through which peer-to-peer vehicle sharing transactions are arranged or administered.

2.7 “Scheduled Start Time”

Scheduled Start Time means the date and time recorded by Mobi at which a Booking is scheduled to begin.

The Scheduled Start Time is the contractual reservation time.

The Scheduled Start Time is not necessarily the Trip Start Time.

2.8 “Control”

Control means actual possession of, access to, and the ability to operate a Vehicle.

Control may be established through:

  • physical possession of the Vehicle keys;

  • possession of a digital key or access credential;

  • successful unlocking of the Vehicle through any technology in partnership with Mobi

  • physical possession and access to the Vehicle where the Vehicle is otherwise made available for operation; or

  • other evidence reasonably establishing that the Guest or Authorized Driver has obtained possession and the ability to operate the Vehicle.

Mere proximity to the Vehicle, arrival at the pickup location, viewing the Vehicle, accessing the Platform, or communicating with the Owner does not, by itself, establish Control.

2.9 “Trip Start Time”

Trip Start Time means the date and time at which the Vehicle becomes subject to the Control of the Booking Guest or Authorized Driver, provided that the Vehicle becomes subject to such Control at or after the Scheduled Start Time.

The Trip Start Time shall be determined using Mobi’s records and other reasonably available evidence.

The Trip Start Time may therefore occur after the Scheduled Start Time if the Guest does not obtain Control of the Vehicle at the Scheduled Start Time.

For example:

      Scheduled Start Time: 2:00 p.m.
      Guest obtains Control: 2:08 p.m.
      Trip Start Time: 2:08 p.m.
If a Guest obtains physical possession or Control before the Scheduled Start Time, the Trip Start Time will not occur before the Scheduled Start Time unless expressly permitted by the applicable Booking or required by applicable law.

2.10 “Trip Period”

Trip Period means the period beginning at the Trip Start Time and ending at the Trip End Time during which the Guest or Authorized Driver has authorized possession and Control of the Vehicle pursuant to a Booking.

Except as expressly provided in these Terms, the Trip Period does not include:

  • any period before the Trip Start Time;

  • any Delivery Period;

  • any period of unauthorized use;

  • any active Rideshare Period (Period 2 or Period 3)

  • any active Commercial Delivery Period (Period 2 or Period 3);

  • or any period after the Trip End Time.

The Trip Period is the principal period used to determine whether a loss, damage, injury, or other event occurred while the Vehicle was subject to the Mobi car sharing program.

2.11 “Trip End Time”

Trip End Time means the earliest of:

  1. the expiration of the agreed Booking period, provided the Vehicle has been returned to the location specified in the Booking;

  2. the time the Vehicle is returned to another location expressly authorized by the Host through the Platform;

  3. the time the Host or the Host’s authorized designee retakes possession and Control of the Vehicle;

  4. the time Mobi terminates the Guest’s authorization to use the Vehicle;

  5. the time the Vehicle is recovered by Mobi, the Owner, law enforcement, a towing provider, or another person authorized to take possession of the Vehicle; or

  6. another time at which the Guest’s authorized possession of the Vehicle terminates under these Terms or applicable law.

The Trip End Time is determined independently of whether the Guest has complied with all obligations arising from the Booking.

A Guest’s failure to timely return a Vehicle does not, by itself, extend the Protection Period or create a new Booking.

2.12 “Late Return”

Late Return means a failure to return the Vehicle by the Scheduled End Time or otherwise applicable Trip End Time.

Unless Mobi expressly extends the Booking, continued possession or operation of a Vehicle after the Trip End Time is unauthorized use.

A Late Return does not automatically extend the Trip Period, Liability Program coverage, or Protection Period.

2.13 “Delivery Period”

Delivery Period means a period during which a Vehicle is being transported or driven by the Owner, Mobi, or an authorized service provider for the purpose of delivering the Vehicle to a Guest’s pickup location before the Trip Start Time.

The Delivery Period is separate from the Trip Period.

Unless expressly stated otherwise in the applicable insurance policy, state-specific program terms, or Protection Plan, the Delivery Period is not part of the Guest’s Protection Period.

Nothing in these Terms prevents a separate insurance policy or other coverage from applying to the Owner or delivery provider during a Delivery Period.

2.14 “Rideshare Period”

Rideshare Period means any period during which a Vehicle is used for or in connection with transportation of passengers for compensation, including any period during which an individual:

  • is logged into a transportation network company or rideshare platform for the purpose of accepting passenger trips;

  • is available to accept a passenger trip;

  • is traveling to pick up a passenger;

  • is transporting a passenger;

  • is completing a passenger transportation trip; or

  • is otherwise using the Vehicle to provide commercial passenger transportation.

Rideshare Period does not include ordinary transportation of family members, friends, or other passengers when no compensation or commercial transportation service is involved.

Rideshare Periods are further defined as:

Period 0: Driver is not logged into or available through a rideshare/delivery platform

Period 1: Driver is logged in and available to receive a ride or delivery request, but has not accepted one

Period 2: Driver has accepted a ride/delivery request and is traveling to pick up the passenger or item

Period 3: Passenger or delivery item has been picked up and the driver is completing the trip/delivery

2.15 “Commercial Delivery Period”

Commercial Delivery Period means any period during which the Vehicle is used to transport goods, merchandise, food, packages, documents, or other property for compensation or in connection with a commercial delivery service.

Commercial Delivery Period includes use in connection with:

  • food delivery;

  • package delivery;

  • courier services;

  • grocery delivery;

  • medical courier services;

  • commercial logistics;

  • or similar commercial delivery activities.

2.16 “Commercial Use”

Commercial Use means use of a Vehicle in connection with a business, trade, occupation, profession, commercial transportation activity, or other activity undertaken for compensation or financial consideration, except for use expressly permitted by the Booking.

Commercial Use includes Rideshare Periods and Commercial Delivery Periods.

2.17 “Unauthorized Use”

Unauthorized Use means any use or possession of a Vehicle:

  1. by a person who is not an Authorized Driver;

  2. before the Trip Start Time;

  3. after the Trip End Time;

  4. for a purpose prohibited by these Terms;

  5. in violation of the Booking;

  6. outside an applicable geographic restriction;

  7. after Mobi has terminated the Guest’s authorization;

  8. in violation of applicable law; or

  9. otherwise outside the scope of the Guest’s authorization.

Unauthorized Use may affect eligibility for the Protection Plan and may result in additional charges, indemnification obligations, or other remedies as permitted by applicable law.

2.18 “Protection Plan”

Protection Plan means the contractual vehicle protection program selected or made available in connection with a Booking that provides specified contractual protection for Covered Physical Damage to an eligible Host Vehicle, subject to applicable deductibles, limits, exclusions, conditions, and other requirements.

The Protection Plan is not insurance.

The Protection Plan does not constitute a motor vehicle liability insurance policy and does not provide third-party bodily injury or property damage liability coverage.

2.19 “Protection Period”

Protection Period means the portion of the Trip Period during which the Protection Plan applies to Covered Physical Damage to the Covered Vehicle.

Unless expressly stated otherwise, the Protection Period begins at the Trip Start Time and ends at the Trip End Time.

The Protection Period does not include:

  • the Delivery Period;

  • any active Rideshare Period (Period 2 or Period 3);

  • any active Commercial Delivery Period (Period 2 or Period 3);

  • any period before the Trip Start Time;

  • any period after the Trip End Time; or

  • any period of Unauthorized Use.

2.20 “Covered Vehicle”

Covered Vehicle means a Vehicle that:

  1. is listed and approved through the Platform;

  2. is the subject of an active Booking;

  3. is eligible for the applicable Protection Plan;

  4. is operated by an Authorized Driver;

  5. is used for an authorized purpose; and

  6. satisfies all applicable eligibility requirements.

2.21 “Covered Physical Damage”

Covered Physical Damage means accidental direct physical loss of or damage to a Covered Vehicle occurring during the Protection Period and otherwise qualifying for protection under the applicable Protection Plan.

Covered Physical Damage does not include any loss or damage specifically excluded by these Terms, the applicable Protection Plan, or applicable law.

2.22 “Liability Program”

Liability Program means the motor vehicle liability insurance program applicable to eligible Vehicle sharing transactions, including insurance maintained by Mobi or another insurer or program participant for purposes of satisfying applicable legal or contractual requirements.

Insurance coverage is governed by the applicable insurance policy and not solely by these Terms.

2.23 “Insurance Policy”

Insurance Policy means the applicable motor vehicle liability or other insurance policy issued by an authorized insurer that provides coverage in connection with the Mobi Platform or a Booking.

2.24 “Protection Period”

For purposes of the Vehicle Protection Plan, the Protection Period is tied to the Trip Period and does not automatically continue because a Guest retains possession of a Vehicle after the Trip End Time.

2.25 “Host’s Vehicle”

Host’s Vehicle means the Vehicle owned or legally controlled by the Owner and made available through the Platform.

The Vehicle remains the property of the Owner unless ownership is otherwise transferred by law or agreement.

2.26 "Underlying Physical Damage Policy"

An Underlying Physical Damage Policy means a valid and collectible automobile insurance policy, or other qualifying physical damage insurance policy, that provides coverage for physical loss of or damage to the Covered Vehicle and is maintained by the Owner or another party with an insurable interest in the Covered Vehicle.

3. THE BOOKING

3.1 Creation of a Booking

A Booking is created when Mobi confirms through the Platform that a Vehicle has been reserved for a Guest.

A Booking establishes the contractual terms applicable to the sharing transaction, including the Vehicle, Guest, Scheduled Start Time, Scheduled End Time, and other applicable conditions.

3.2 No Transfer of Ownership

A Booking does not transfer ownership of the Vehicle to the Guest.

The Guest receives only the limited right to possess and operate the Vehicle during the authorized Trip Period and solely for the purposes permitted by these Terms and the Booking.

3.3 Limited Authorization

The Host authorizes the Guest to possess and operate the Vehicle only:

  • during the Trip Period;

  • for the purposes permitted by the Booking;

  • in accordance with applicable law;

  • subject to the limitations of the Protection Plan; and

  • subject to these Terms.

The authorization automatically terminates at the Trip End Time unless Mobi expressly extends the Booking.

3.4 Guest Eligibility

Mobi may require a Guest to complete identity verification, driver’s license verification, payment verification, fraud screening, risk assessment, and other eligibility procedures before allowing a Booking.

Mobi may deny or cancel a Booking where the Guest does not satisfy applicable eligibility requirements or for any other reason at its discretion.

3.5 Additional Drivers

No person may operate the Vehicle unless that person is an Authorized Driver.

The Guest is responsible for ensuring that no unauthorized person operates the Vehicle.

The Guest may be responsible for damage or loss resulting from operation by an unauthorized driver to the extent permitted by applicable law and the Protection Plan.

4. ESTABLISHING THE TRIP PERIOD

4.1 General Rule

For purposes of the Mobi Platform, the critical coverage question is whether an event occurred during the Trip Period.

The Trip Period begins at the Trip Start Time and ends at the Trip End Time.

The Scheduled Start Time establishes the earliest contractual point at which the Trip Start Time may occur.

4.2 Determination of Trip Start Time

Mobi may determine the Trip Start Time using any reasonably reliable information available to it, including:

  • reservation records;

  • digital key records;

  • vehicle unlock records;

  • telematics;

  • GPS information;

  • vehicle ignition data;

  • odometer information;

  • photographs;

  • Guest statements;

  • Owner statements;

  • communications through the Platform;

  • access logs;

  • location data;

  • and other information reasonably relevant to establishing possession and Control.

4.3 Determination of Trip End Time

Mobi may determine the Trip End Time using the same or similar information, including:

  • vehicle return records;

  • digital lock records;

  • telematics;

  • GPS;

  • vehicle ignition data;

  • photographs;

  • Owner confirmation;

  • Guest confirmation;

  • towing or recovery records;

  • communications;

  • and other reasonably reliable evidence.

4.4 Disputes Regarding Control

If there is a dispute regarding who had possession or Control of the Vehicle at the time of a loss, Mobi may use the records described above to determine the applicable Trip Start Time and Trip End Time, subject to applicable law and the terms of the applicable Insurance Policy.

The parties acknowledge that accurate electronic records are necessary to administer the Platform and determine whether a loss occurred during an authorized Trip Period.

5. DELIVERY, RIDESHARE, AND COMMERCIAL USE

5.1 Delivery Is Separate From the Guest’s Trip

A Vehicle may be transported or driven to a pickup location before the Guest takes Control of the Vehicle.

Such transportation constitutes a Delivery Period when performed for the purpose of delivering the Vehicle to the Guest.

Unless expressly provided otherwise, the Delivery Period is not part of the Guest’s Trip Period.

5.2 No Coverage Assumption

The fact that a Vehicle is physically present in a Rideshare Period or Commercial Delivery Period does not establish that the Mobi Liability Program or Protection Plan applies to the loss.

Eligibility for protection is determined under the applicable Insurance Policy and Protection Plan.

6. LIABILITY INSURANCE PROGRAM

6.1 Liability Protection During the Trip Period

Subject to applicable law and the terms of the applicable Insurance Policy, eligible Owners and Guests may be provided motor vehicle liability protection during the Trip Period. Mobi provides insurance coverage through our trusted insurance partner, TeqMobility.

Where Mobi provides insurance required by applicable peer-to-peer vehicle sharing law through its party TeqMobility, that insurance will be provided in accordance with the applicable statute and Insurance Policy.

6.2 Insurance Governs Insurance Coverage

The applicable Insurance Policy governs:

  • covered persons;

  • covered vehicles;

  • covered losses;

  • limits;

  • deductibles or self-insured amounts;

  • exclusions;

  • defense obligations;

  • indemnification;

  • conditions;

  • cancellation;

  • and other insurance terms.

Nothing in these Terms is intended to expand, restrict, replace, or amend the terms of an Insurance Policy except to the extent permitted by law.

6.3 Primary Coverage

Where applicable law requires the Mobi insurance program to provide primary coverage during the Trip Period, the applicable Insurance Policy shall apply as required by law.

6.4 Liability Coverage Does Not Equal Vehicle Protection

Liability insurance protects against covered third-party liability and other losses identified in the applicable Insurance Policy.

It does not necessarily provide protection for physical damage to the Host’s Vehicle.

Physical damage protection for the Owner’s Vehicle is addressed separately through the Protection Plan.

6.5 Liability Coverage Territory

The Liability Program applies only to eligible Trips occurring within the fifty (50) states of the United States of America.

No coverage under the Liability Program applies to any accident, loss, or occurrence outside the fifty (50) states, subject in all cases to the terms, conditions, limitations, and territory provisions of the applicable Insurance Policy and applicable law.

7. MOBI VEHICLE PROTECTION PLAN (Vehicle Protection Terms here)

7.1 Nature of the Protection Plan

The Mobi Vehicle Protection Plan is a contractual program designed to provide specified protection to an eligible Host and Vehicle for Covered Physical Damage to a Covered Vehicle.

THE PROTECTION PLAN IS NOT INSURANCE.

The Protection Plan does not provide third-party liability insurance and does not replace the Liability Program or any insurance required by law.

7.2 Selection of Protection Plan

Where Mobi offers multiple Protection Plan options, the applicable Protection Plan will be identified in the Booking or transaction record.

The applicable Protection Plan may establish:

  • a deductible or Owner responsibility amount;

  • maximum protection;

  • covered causes of loss;

  • exclusions;

  • claims procedures;

  • documentation requirements;

  • recovery rights;

  • and other limitations.

7.3 Underlying Physical Damage Coverage Requirement

Eligibility for and availability of the Mobi Vehicle Protection Plan is expressly conditioned upon the existence of a valid and collectible Underlying Physical Damage Policy covering the Covered Vehicle.

The Owner must maintain qualifying physical damage insurance on the Vehicle throughout the period in which the Vehicle is listed on the Mobi Platform and must maintain such insurance as required by these Terms and applicable law.

The Protection Plan is not intended to replace, duplicate, or serve as a substitute for the Owner's underlying physical damage insurance.

If the Owner does not maintain a valid Underlying Physical Damage Policy, the Vehicle may be ineligible for the Protection Plan, and Mobi may suspend or remove the Vehicle from the Platform.

The Owner must promptly notify Mobi if the Underlying Physical Damage Policy is cancelled, non-renewed, suspended, materially restricted, or otherwise ceases to provide physical damage coverage for the Vehicle.

7.4 Protection Begins With the Trip

Unless otherwise expressly provided in the applicable Protection Plan, protection for Covered Physical Damage begins at the Trip Start Time.

Protection does not begin merely because:

  • a reservation has been created;

  • the Guest has arrived at the pickup location;

  • the Guest has been approved;

  • the Vehicle is being delivered;

  • the Guest has accessed the Platform;

  • or the Guest is physically near the Vehicle.

7.5 Protection Ends With the Trip

Unless otherwise expressly provided, protection for Covered Physical Damage ends at the Trip End Time.

A Guest’s continued possession of the Vehicle after the Trip End Time does not automatically extend the Protection Period.

7.6 Protection Is Subject to Conditions

Protection under the Protection Plan is subject to the Guest and Owner complying with these Terms and the applicable Protection Plan.

A failure to comply may result in:

  • denial of a protection claim;

  • reduction of the amount payable;

  • recovery from the responsible party;

  • additional fees;

  • or other remedies permitted by the Protection Plan and applicable law.

8. OWNER RESPONSIBILITIES

The Owner agrees to:

  1. report all claims within 72 hours of the Trip End Time;

  2. Cooperate fully with any and all reasonable requests in relation to a claims investigation such as statements, activities, reports, affidavits or additional information required throughout a claims process;

  3. provide accurate information concerning the Vehicle and nature of the loss;

  4. maintain legal ownership or authorization to list the Vehicle;

  5. maintain required registration;

  6. disclose known material damage or safety issues;

  7. maintain the Vehicle in a reasonably safe and roadworthy condition;

  8. comply with applicable inspection and maintenance requirements;

  9. remove personal property before a Booking where appropriate;

  10. provide accurate Vehicle condition information;

  11. cooperate with Mobi’s claims investigation;

  12. promptly report accidents, damage, theft, or other material events;

  13. cooperate with insurers, claims administrators, law enforcement, and recovery providers when required;

  14. comply with applicable insurance requirements; and

  15. comply with these Terms and all applicable laws.

8.1 Owner Representations

The Owner represents that:

  • the Owner has authority to list the Vehicle;

  • the Vehicle is not stolen;

  • the Vehicle is not subject to undisclosed restrictions preventing peer-to-peer sharing;

  • information provided to Mobi is accurate;

  • the Owner has disclosed material known damage;

  • and the Owner will not intentionally conceal material facts concerning the Vehicle.

9. GUEST RESPONSIBILITIES

The Guest agrees to:

  1. use the Vehicle only during the authorized Trip Period;

  2. Report all claims as soon as practical to both the Host and Mobi;

  3. operate the Vehicle only for permitted purposes;

  4. operate the Vehicle only if the Guest is an Authorized Driver;

  5. comply with applicable laws;

  6. use reasonable care;

  7. not permit unauthorized persons to operate the Vehicle;

  8. promptly report accidents and damage;

  9. cooperate with claims investigations;

  10. return the Vehicle as required;

  11. not use the Vehicle for prohibited commercial purposes;

  12. not tamper with telematics or safety equipment;

  13. not disable or interfere with Mobi technology; and

  14. comply with all Booking-specific requirements.

10. PROHIBITED USES

Unless expressly authorized by Mobi, the following are prohibited:

10.1 Unauthorized Drivers

Allowing an individual who is not an Authorized Driver to operate the Vehicle.

10.2 Racing

Using the Vehicle for racing, speed contests, track events, or performance testing.

10.3 Off-Road Use

Using the Vehicle off paved or reasonably maintained public or private roads where such use is not authorized.

10.3 Towing

Using the Vehicle to tow another vehicle or trailer unless expressly authorized.

10.5 Illegal Activity

Using the Vehicle in connection with illegal activity.

10.6 Intentional Damage

Intentionally damaging the Vehicle or using the Vehicle in a manner reasonably likely to cause intentional damage.

10.7 Impaired Driving

Operating the Vehicle while impaired by alcohol, cannabis, controlled substances, or any other substance that impairs the ability to safely operate a motor vehicle.

10.8 Tampering

Disabling, removing, altering, or interfering with:

  • GPS equipment;

  • telematics;

  • odometers;

  • vehicle safety systems;

  • digital access systems;

  • cameras;

  • or other Mobi equipment.

11. CLAIMS AND LOSS REPORTING

11.1 Immediate Reporting

The Guest and Owner must promptly report any claim via the application in instances of the following:

  • collision;

  • theft;

  • vandalism;

  • fire;

  • physical damage;

  • bodily injury;

  • property damage;

  • mechanical event involving suspected accident-related damage;

  • or other events reasonably likely to result in a claim.

  • Claims reported in excess of 72 hours from the Trip End time will not be eligible for payment under the Vehicle Protection Plan.

Third parties or vendors may inquire on a claim or report a new claim here.

11.2 Cooperation

The Guest and Host must reasonably cooperate with Mobi, the applicable insurer, claims administrator, investigators, law enforcement, and other authorized parties.

Cooperation may include providing:

  • statements;

  • photographs;

  • video;

  • telematics information;

  • police reports;

  • repair information;

  • receipts;

  • witness information;

  • driver’s license information;

  • and other information reasonably necessary to evaluate the claim.

11.3 Determination of Coverage Period

When evaluating a claim, Mobi may first determine:

  1. whether an active Booking existed;

  2. the Scheduled Start Time;

  3. the Trip Start Time;

  4. the Trip End Time;

  5. whether the person operating the Vehicle was an Authorized Driver;

  6. whether the use was authorized;

  7. whether the loss occurred during the Trip Period;

  8. whether the loss occurred during a Rideshare Period or Commercial Delivery Period;

  9. whether the loss involves third-party liability or physical damage to the Vehicle; and

  10. whether the applicable Insurance Policy or Protection Plan responds.

This framework is intended to allow Mobi to make an initial coverage determination before evaluating the amount of a loss.

12. RECORDS AND ELECTRONIC EVIDENCE

Mobi may maintain records reasonably necessary to administer the Platform and determine the circumstances of a Booking.

Such records may include:

  • reservation information;

  • Booking modifications;

  • Guest identity information;

  • driver authorization;

  • digital key activity;

  • Vehicle access records;

  • telematics;

  • GPS;

  • odometer information;

  • photographs;

  • messages;

  • payment records;

  • Vehicle condition reports;

  • claims records;

  • and other information reasonably related to the sharing transaction.

Mobi may use these records to determine the Trip Start Time, Trip End Time, authorized driver, Vehicle location, and circumstances of a reported loss, subject to applicable law.

13. SUBROGATION AND RECOVERY

To the extent permitted by applicable law and the applicable Protection Plan or Insurance Policy, Mobi, its insurers, administrators, and other entities providing protection may pursue recovery from any person responsible for a covered loss.

The Host and Guest agree to cooperate with reasonable recovery efforts.

Neither the Host nor Guest may impair or waive applicable recovery rights without Mobi’s written authorization.

14. INDEMNIFICATION

To the extent permitted by applicable law, a Host or Guest may be responsible for losses arising from that party’s breach of these Terms, including unauthorized use, intentional misconduct, fraud, material misrepresentation, or other conduct outside the scope of the Booking.

Nothing in this section limits insurance coverage that must be provided under applicable law.

15. STATE-SPECIFIC REQUIREMENTS

Mobi may maintain state-specific terms, disclosures, insurance provisions, and Protection Plan provisions.

Where a state law establishes requirements that differ from these general Terms, the applicable state-specific provisions will govern to the extent required by law.

Mobi may provide state-specific disclosures through:

  • the Platform;

  • the Booking;

  • these Terms;

  • a Protection Plan schedule;

  • an insurance disclosure;

  • or a separate state addendum.

16. ORDER OF PRECEDENCE

In the event of a conflict, the following order of precedence applies:

  1. applicable law;

  2. applicable Insurance Policy, with respect to insurance coverage;

  3. applicable state-specific mandatory terms;

  4. the applicable Protection Plan, with respect to contractual vehicle protection;

  5. the Booking-specific terms; and

  6. these general Terms.

No provision of these Terms is intended to reduce coverage or rights that cannot lawfully be limited or waived.

17. ACKNOWLEDGMENT

By using the Mobi Platform, listing a Vehicle, accepting a Booking, or operating a Vehicle through the Platform, the Owner and Guest acknowledge that:

  • peer-to-peer vehicle sharing is distinct from traditional retail car rental;

  • the Trip Period is determined by the Trip Start Time and Trip End Time;

  • the Scheduled Start Time does not necessarily establish the Trip Start Time;

  • possession and Control of the Vehicle are material to determining the Trip Start Time;

  • the Trip Period does not automatically include Delivery Periods;

  • Rideshare and Commercial Delivery periods of 2 and period 3 are not insured through the Liability Insurance provided, nor is any Protection Plan service;

  • the Protection Plan is contractual protection and is not insurance;

  • insurance coverage is governed by the applicable Insurance Policy; and

  • the parties are responsible for complying with these Terms and the applicable Booking.
