Mobi (Drivemobi, Inc.) Vehicle Protection Plan Terms
Effective Date: 8/01/2026
Last Updated: 8/25/2026
These Mobi Vehicle Protection Plan Terms ("Protection Plan Terms") govern the Vehicle Protection Plan ("Protection Plan") made available by Mobi ("Mobi") to eligible Hosts who list vehicles on the Mobi peer-to-peer vehicle sharing platform (the "Platform").
The Protection Plan provides contractual protection for certain physical loss of or damage to an eligible vehicle ("Covered Vehicle") occurring during an eligible peer-to-peer vehicle sharing trip, subject to the terms, conditions, exclusions, deductibles, limits, and requirements described in these Protection Plan Terms.
THE MOBI VEHICLE PROTECTION PLAN IS NOT INSURANCE.
The Protection Plan is a contractual arrangement between Mobi and an eligible participant. It does not constitute a motor vehicle insurance policy, does not provide third-party bodily injury or property damage liability insurance, and does not replace any insurance required by law.
Any motor vehicle liability insurance associated with a Mobi Booking is governed by the applicable insurance policy and is separate from the Protection Plan.
The Protection Plan is designed to address physical damage to the Host's Covered Vehicle and is contingent upon the existence of an existing and active underlying comprehensive and collision policy covering the vehicle in question.
It should not be confused with:
motor vehicle liability insurance;
bodily injury coverage;
third-party property damage liability coverage;
uninsured or underinsured motorist coverage;
personal injury protection;
medical payments coverage;
workers' compensation;
commercial insurance; or
any other insurance product.
The Protection Plan may provide contractual protection for qualifying physical damage to the Covered Vehicle, but it does not provide coverage for liability to third parties.
For purposes of these Protection Plan Terms, the following definitions apply.
3.1 Booking
"Booking" means a confirmed reservation through the Platform for the use of a specific Vehicle by an eligible Guest during a specified period.
3.2 Host
"Host" means the individual or legal entity that owns, leases with the legal right to share, or otherwise has a legally recognized ownership or insurable interest in the Vehicle and is authorized to list the Vehicle on the Platform.
For purposes of receiving any compensation, reimbursement, or other payment under the Protection Plan, the Host must have a valid ownership interest or other legally recognized insurable interest in the Covered Vehicle at the time of the applicable loss.
Listing a Vehicle on the Platform, possessing the Vehicle, having access to the Vehicle, or being authorized by another person to manage or operate the Vehicle does not, by itself, establish an ownership interest for purposes of receiving Protection Plan benefits.
3.3 Guest
"Guest" means the individual identified in a Booking as the person authorized by Mobi to possess and operate the Covered Vehicle during the Trip Period.
3.4 Authorized Driver
"Authorized Driver" means the Guest or another individual expressly approved by Mobi to operate the Covered Vehicle under the applicable Booking.
3.5 Covered Vehicle
"Covered Vehicle" means a Vehicle that:
has been approved by Mobi;
is listed on the Platform;
is subject to an active Booking;
is eligible for the selected Protection Plan;
is operated only by an Authorized Driver;
is used for an authorized purpose; and
satisfies all other applicable eligibility requirements.
3.6 Scheduled Start Time
"Scheduled Start Time" means the date and time recorded by Mobi at which a Booking is scheduled to begin.
3.7 Control
"Control" means actual possession of, access to, and the ability to operate the Vehicle.
Control may be established through physical possession of the keys, use of a digital key, successful unlocking of the Vehicle, or other reasonably reliable evidence that the Guest or Authorized Driver has obtained possession and the ability to operate the Vehicle.
3.8 Trip Start Time
"Trip Start Time" means the date and time at which the Covered Vehicle becomes subject to the Control of the Guest or Authorized Driver, provided that such time is at or after the Scheduled Start Time.
The Trip Start Time may occur after the Scheduled Start Time if the Guest does not obtain Control of the Vehicle at the Scheduled Start Time.
The Trip Start Time will not occur before the Scheduled Start Time solely because the Guest arrives early or otherwise gains physical access to the Vehicle before the scheduled Booking time, unless otherwise expressly authorized by Mobi.
3.9 Trip End Time
"Trip End Time" means the earliest of:
expiration of the Booking period following return of the Vehicle to the agreed location;
return of the Vehicle to another location expressly authorized by Mobi;
the time the Host or the Host's authorized representative retakes possession and Control of the Vehicle;
the time Mobi terminates the Guest's authorization to use the Vehicle;
the time the Vehicle is recovered by Mobi, the Host, law enforcement, a towing provider, or another authorized party; or
another event that terminates the Guest's authorized possession under the Booking or applicable law.
3.10 Trip Period
"Trip Period" means the period beginning at the Trip Start Time and ending at the Trip End Time.
The Protection Plan generally applies only to Covered Physical Damage occurring during the Trip Period.
3.11 Protection Period
"Protection Period" means the period during which the Protection Plan applies to a Covered Vehicle.
Unless otherwise expressly stated, the Protection Period begins at the Trip Start Time and ends at the Trip End Time.
3.12 Delivery Period
"Delivery Period" means any period during which a Vehicle is being transported or driven by the Host, Mobi, or an authorized service provider for the purpose of delivering the Vehicle to the Guest's pickup location before the Trip Start Time.
The Delivery Period is separate from the Protection Period.
Unless expressly stated otherwise, the Protection Plan does not apply during the Delivery Period.
3.13 Rideshare Period
"Rideshare Period" means any period during which the Vehicle is used for or in connection with commercial passenger transportation, including while the Guest is:
traveling to pick up a passenger;
transporting a passenger;
completing a passenger trip; or
otherwise providing passenger transportation for compensation.
3.14 Commercial Delivery Period
"Commercial Delivery Period" means any period during which the Vehicle is used to transport goods, food, packages, merchandise, or other property for compensation or in connection with a commercial delivery or courier service to include:
Traveling to pick up a good from an assigned location;
Actively transporting an item to a destination as booked through a commercial delivery service.
3.15 Unauthorized Use
"Unauthorized Use" means use or possession of the Covered Vehicle:
by a person who is not an Authorized Driver;
before the Trip Start Time;
after the Trip End Time;
during a Delivery Period;
for a prohibited purpose;
outside the geographic restrictions of the Booking;
after Mobi terminates authorization; or
otherwise in violation of these Protection Plan Terms or the Booking.
3.16 Underlying Physical Damage Policy
"Underlying Physical Damage Policy" means a valid and collectible automobile insurance policy or other qualifying physical damage insurance policy that provides protection for physical loss of or damage to the Covered Vehicle and is maintained by the Host or another party with an insurable interest in the Covered Vehicle.
3.17 Covered Physical Damage
"Covered Physical Damage" means accidental direct physical loss of or damage to a Covered Vehicle occurring during the Protection Period and otherwise eligible for protection under these Protection Plan Terms.
4.1 Eligible Hosts
The Protection Plan is available only to Hosts whose Vehicles satisfy Mobi's applicable eligibility requirements.
Mobi may establish eligibility requirements relating to:
Vehicle age;
make and model;
mileage;
title;
registration;
condition;
safety;
inspection;
geographic location;
financing or lienholder requirements;
underlying insurance;
and other risk characteristics.
Mobi may require the Host to demonstrate an ownership or legally recognized insurable interest in the Covered Vehicle as a condition of eligibility for the Protection Plan and receipt of Protection Plan benefits.
4.2 Eligible Vehicles
A Vehicle must be approved by Mobi before it may receive Protection Plan benefits.
Mobi may suspend or terminate a Vehicle's eligibility if:
the Vehicle no longer satisfies eligibility requirements;
required insurance is cancelled;
material information about the Vehicle changes;
the Vehicle becomes unsafe;
the Host fails to comply with these Terms; or
Mobi reasonably determines that continued eligibility presents unacceptable risk.
5.1 Ownership Interest Requirement
Only an eligible Host or other person with a valid ownership or legally recognized insurable interest in the Covered Vehicle may receive compensation or other financial benefits under the Protection Plan.
The person or entity identified as the Host must have an ownership interest or other legally recognized insurable interest in the Covered Vehicle in order to receive Protection Plan compensation.
5.2 Listing Authority Is Not Sufficient
Authorization to list, manage, possess, operate, store, or administer a Vehicle does not, by itself, establish an ownership or insurable interest.
A person may not receive Protection Plan compensation solely because that person:
created the Vehicle listing;
manages the Vehicle for another person;
possesses the Vehicle;
has access to the Vehicle;
has permission to rent or share the Vehicle;
receives Booking proceeds;
is designated as a Host; or
has entered into a management agreement with the Vehicle's owner.
5.3 Verification of Ownership Interest
Mobi may require reasonable documentation establishing the Host's ownership or insurable interest before approving a Vehicle or before paying a claim.
Such documentation may include:
vehicle title;
registration;
purchase documents;
lease documents;
financing documents;
fleet ownership records;
corporate ownership records; or
other documentation reasonably demonstrating the Host's legal or insurable interest.
5.4 Multiple Owners
Where a Covered Vehicle is jointly owned by multiple individuals or entities, Mobi may require documentation establishing the authority of the Host to list the Vehicle and receive Protection Plan benefits on behalf of the other owners.
Payment to the Host will not make Mobi responsible for determining or resolving disputes among owners, lienholders, lessors, or other persons claiming an interest in the Covered Vehicle.
6.1 Requirement to Maintain Underlying Coverage
Eligibility for the Protection Plan is expressly conditioned upon the existence of an Underlying Physical Damage Policy covering the Covered Vehicle.
The Host must maintain qualifying physical damage insurance as required by applicable law, any lienholder or financing agreement, and these Protection Plan Terms.
The Host is responsible for ensuring that the Vehicle remains insured as required while it is listed on the Platform.
6.2 Protection Plan Is Not a Substitute for Insurance
The Protection Plan is not intended to replace the Host's automobile insurance.
The Host remains responsible for maintaining all insurance required by law or contract.
The Protection Plan does not constitute evidence of insurance and should not be represented to any person as a substitute for an insurance policy.
6.3 Verification
Mobi may require evidence of the Underlying Physical Damage Policy before approving a Vehicle and at any time thereafter.
Evidence may include:
declarations pages;
insurance cards;
policy information;
insurer information;
coverage limits;
effective dates;
expiration dates; or
other documentation reasonably necessary to verify physical damage coverage.
6.4 Changes to Underlying Coverage
The Host must promptly notify Mobi if the Underlying Physical Damage Policy:
is cancelled;
expires;
is non-renewed;
is suspended;
becomes unavailable;
materially changes;
excludes physical damage coverage for the Vehicle; or
otherwise ceases to provide qualifying physical damage coverage.
Failure to maintain qualifying underlying insurance may result in suspension or termination of Protection Plan eligibility.
7.1 Separate Contractual Protection
The Protection Plan is separate from the Underlying Physical Damage Policy.
The Underlying Physical Damage Policy is an insurance contract between the Host and the applicable insurer.
The Protection Plan is a contractual protection arrangement between Mobi and the eligible Host.
7.2 No Modification of Underlying Insurance
Nothing in these Protection Plan Terms:
modifies the Host's insurance policy;
creates coverage under the Host's insurance policy;
changes an insurer's obligations;
waives an insurer's exclusions;
or guarantees that the Underlying Physical Damage Policy will respond to a particular loss.
7.3 Submission to Underlying Insurer
Mobi may require the Host to submit a claim to the Underlying Physical Damage Policy before Mobi determines the amount, if any, payable under the Protection Plan.
The Host must cooperate with reasonable requests concerning the underlying claim.
7.4 Underlying Insurer's Denial
An insurer's denial of a claim under the Underlying Physical Damage Policy does not, by itself, determine whether the Protection Plan applies.
Mobi will evaluate the claim independently under these Protection Plan Terms.
Likewise, the existence of an Underlying Physical Damage Policy does not guarantee that Mobi will provide Protection Plan benefits.
7.5 No Double Recovery
A Host may not recover more than the Host's actual covered physical loss through a combination of:
the Underlying Physical Damage Policy;
the Protection Plan;
a responsible third party;
another insurer; or
another source of recovery.
Any amounts received from another source relating to the same loss may reduce the amount otherwise payable under the Protection Plan to the extent necessary to prevent double recovery.
8.1 General Rule
Subject to all conditions and exclusions, the Protection Plan applies to Covered Physical Damage occurring during the Protection Period.
8.2 Protection Plan Territory
The Protection Plan applies only to Covered Physical Damage that occurs within the fifty (50) states of the United States of America ("Coverage Territory").
The Protection Plan does not apply to any loss or damage occurring outside the Coverage Territory, including in the District of Columbia, Puerto Rico, any United States territory or possession, Canada, Mexico, or any other country or territory.
8.3 Beginning of Protection
Protection begins at the Trip Start Time.
Protection does not begin merely because:
a Booking has been created;
a Guest has been approved;
a Guest has arrived at the pickup location;
a Guest has accessed the Platform;
the Vehicle is being delivered; or
the Guest is physically near the Vehicle.
8.4 End of Protection
Protection ends at the Trip End Time.
A Guest's continued possession of the Vehicle after the Trip End Time does not automatically extend the Protection Period.
8.5 Early Termination
The Protection Period may end before the scheduled Booking end time if:
the Host retakes possession and Control;
Mobi terminates the Booking;
the Vehicle is recovered;
the Vehicle is stolen; or
another event terminates the Guest's authorized possession.
Subject to the applicable Protection Plan selected for the Booking, Covered Physical Damage may include:
9.1 Collision Damage
Accidental physical damage resulting from collision with:
another vehicle;
an object;
a stationary structure; or
another physical object.
9.2 Comprehensive-Type Damage
Where included in the selected Protection Plan, accidental physical damage resulting from events such as:
theft;
attempted theft;
vandalism;
falling objects;
fire;
hail;
flood;
windstorm; or
other specified causes.
9.3 Glass Damage
Damage to glass may be eligible for protection subject to the applicable Protection Plan and any separate glass deductible or limitation.
9.4 Maximum Protection Plan Benefit / Economically Impractical to Repair
Where the cost to repair the Covered Vehicle exceeds the applicable threshold, or where the Vehicle is otherwise determined to not be economically practical to repair under the applicable valuation methodology, the Protection Plan may provide benefits subject to the applicable limit and terms.
9.5 Towing and Storage
Reasonable towing and storage expenses resulting directly from a covered loss may be eligible for reimbursement when:
authorized by Mobi;
reasonably necessary;
documented; and
within applicable limits.
10.1 Deductible
The Host is responsible for the deductible specified in the Protection Plan selected for the applicable Booking.
The deductible applies separately to each covered occurrence unless otherwise stated. The total value of the claim will be reduced by the applicable deductible. For example, the total repair cost = $10,000 and the deductible is $2500. The total payment to the host is $7500.
10.2 Host Responsibility
The Host may be responsible for amounts not protected by the Protection Plan, including:
the applicable deductible;
excluded damage;
pre-existing damage;
depreciation;
loss of value;
amounts exceeding the applicable protection limit;
damage resulting from prohibited use; and
other amounts expressly excluded.
10.3 No Recovery Beyond Actual Loss
The Protection Plan is intended to restore the Host, subject to its terms, to no more than the Host's actual covered physical loss.
The Protection Plan does not create an opportunity for profit from a covered loss.
Unless expressly stated otherwise in a particular Protection Plan, the following are not Covered Physical Damage.
11.1 Mechanical or Electrical Failure
Mechanical, electrical, or internal component failure that does not result from an otherwise covered accidental event.
11.2 Wear and Tear
Ordinary wear and tear, deterioration, corrosion, rust, weathering, or gradual deterioration.
11.3 Pre-Existing Damage
Damage that existed before the Trip Start Time.
11.4 Maintenance
Routine maintenance or servicing, including:
oil changes;
fluid replacement;
brake service;
tire replacement due to wear;
scheduled maintenance;
battery replacement; or
similar maintenance.
11.5 Weather and Environmental Conditions
Loss or damage caused by or resulting from:
Flood, flash flood, surface water, rising water, storm surge, tidal water, or overflow of any body of water;
Rain, wind, windstorm, hail, sleet, snow, ice, freezing, or accumulation of snow or ice;
Lightning;
Extreme heat or cold, including freezing or overheating;
Falling trees, branches, limbs, or other natural debris when caused by weather or environmental conditions;
Mudslide, mudflow, landslide, rockslide, earth movement, erosion, subsidence, or sinkhole;
Sand, dust, ash, smoke, or other airborne natural materials;
Water intrusion or water damage resulting from weather, flooding, drainage, or exposure to the elements; or
Any other naturally occurring atmospheric, climatic, geological, or environmental condition.
11.6 Catastrophic Events and Natural Disasters
Loss or damage caused by or resulting from a catastrophic event or natural disaster, including but not limited to:
Hurricane, tropical storm, cyclone, tornado, or severe windstorm;
Earthquake, earth movement, volcanic eruption, or tsunami;
Wildfire, brush fire, forest fire, or other naturally occurring fire;
Flood or widespread flooding;
Avalanche, landslide, mudslide, or similar earth movement;
Severe hail, ice storm, snowstorm, blizzard, or other severe weather event;
A state of emergency or disaster declared by a federal, state, provincial, territorial, tribal, or local governmental authority; or
Any other widespread or catastrophic natural event affecting multiple vehicles, properties, or persons within a geographic area.
11.7 Governmental and Civil Events
The Protection Plan also does not provide protection for loss or damage arising directly or indirectly from:
War, invasion, acts of foreign enemies, hostilities, civil war, rebellion, revolution, or insurrection;
Terrorism or acts intended to intimidate or coerce a civilian population or government;
Riot, civil commotion, widespread civil disturbance, or looting;
Nuclear reaction, nuclear radiation, or radioactive contamination;
Seizure, confiscation, destruction, quarantine, or other action by a governmental or public authority; or
Any similar extraordinary or catastrophic event beyond the ordinary risks associated with use of the Shared Vehicle.
11.8 Concurrent or Contributing Causes
This exclusion applies regardless of whether another cause or event contributes concurrently, sequentially, or in any other manner to the loss, except where prohibited by applicable law.
11.9 Interior Damage
Interior damage caused by:
ordinary use;
excessive wear;
stains;
smoking;
food or beverage spills;
pet damage; or
other excluded conduct,
unless specifically included in the selected Protection Plan.
11.10 Personal Property
Loss of or damage to personal property contained in the Vehicle.
11.11 Diminished Value
Diminished value or loss in resale value unless expressly included in the applicable Protection Plan.
11.12 Loss of Use
Loss of use, rental replacement costs, lost revenue, or similar economic losses unless expressly included in the applicable Protection Plan.
11.13 Custom Parts, Equipment, Modifications, and Accessories
Unless expressly included in the applicable Protection Plan or otherwise agreed to in writing by Mobi, the Protection Plan does not provide protection for loss of or damage to any Custom Parts, Equipment, Modifications, or Accessories installed in, on, or attached to the Covered Vehicle that are not original equipment manufactured or supplied by the Vehicle manufacturer ("OEM Equipment").
For purposes of this Section, Custom Parts, Equipment, Modifications, and Accessories include, without limitation:
aftermarket wheels, rims, and tires that differ from the manufacturer's original specifications;
suspension modifications, including lifts, lowering kits, coilovers, and other suspension components;
performance modifications, including engine, exhaust, intake, turbocharger, supercharger, tuning, or other performance equipment;
aftermarket audio, entertainment, or electronic equipment;
aftermarket cameras, sensors, radar, or other electronic devices;
custom lighting, including LED systems and auxiliary lighting;
aftermarket body panels, spoilers, wings, bumpers, grilles, fenders, hoods, or other body modifications;
vehicle wraps, graphics, decals, or other customized exterior finishes;
custom paint or specialty finishes;
aftermarket security or tracking equipment;
roof racks, cargo systems, bike racks, ski racks, or similar equipment;
towing equipment, winches, hitches, and related accessories;
camper equipment, rooftop tents, sleeping platforms, or similar equipment;
specialized interior equipment or modifications;
custom seats, upholstery, flooring, or interior installations;
mobility, accessibility, or adaptive equipment, unless expressly approved by Mobi;
tools, equipment, or property carried in or attached to the Vehicle;
specialty or recreational equipment;
and any other non-OEM component, accessory, modification, or equipment that materially differs from the Vehicle's original factory configuration.
11.14 OEM Replacement Parts
The use of a non-OEM replacement part in the repair of otherwise Covered Physical Damage does not, by itself, make the underlying physical damage ineligible for protection.
However, Mobi's obligation under the Protection Plan is limited to the reasonable cost of repairing the Covered Vehicle to a condition consistent with the applicable Protection Plan and Mobi's repair standards. Mobi is not responsible for the additional cost of restoring, upgrading, replacing, or improving a custom or aftermarket component beyond the amount reasonably necessary to repair the Covered Vehicle.
11.15 Damage to Custom Equipment
Damage to Custom Parts, Equipment, Modifications, or Accessories is excluded even when the underlying event causing the damage is otherwise a Covered Physical Damage loss, unless the applicable Protection Plan expressly provides protection for the particular item.
For example, if a collision damages both the Covered Vehicle and an aftermarket suspension system, Mobi may provide protection for the eligible damage to the Covered Vehicle but will not be responsible for the aftermarket suspension system unless expressly covered.
11.16 Increased Vehicle Value
The presence of Custom Parts, Equipment, Modifications, or Accessories does not increase the applicable Protection Plan limit or the value of the Covered Vehicle for purposes of determining a covered loss.
Unless expressly stated otherwise, Mobi will not provide additional compensation based on:
increased market value resulting from modifications;
customization costs;
installation costs;
replacement costs exceeding the applicable OEM-equivalent component;
or claimed diminished value resulting from damage to a customized Vehicle.
11.17 Disclosure and Approval
The Host must disclose to Mobi any material Custom Parts, Equipment, Modifications, or Accessories that may affect the Vehicle's value, safety, operation, insurability, or eligibility for the Protection Plan.
Mobi may require photographs, receipts, appraisals, documentation, or other information concerning any such equipment or modification.
Mobi may, in its discretion, approve specified Custom Parts, Equipment, Modifications, or Accessories for inclusion in the Protection Plan and may impose additional terms, limits, deductibles, or conditions.
Unless Mobi expressly confirms coverage in writing, disclosure of a modification or accessory does not constitute approval or create protection for that item.
11.18 Unauthorized Modifications
Protection Plan benefits may be denied or limited for damage arising from an unauthorized modification, alteration, or installation that:
affects the safety or operation of the Vehicle;
violates applicable law;
violates the manufacturer's specifications;
violates a lienholder or financing agreement;
materially changes the Vehicle's intended use;
or contributes to the loss.
11.19 No Upgrade Obligation
The Protection Plan does not require Mobi to replace an OEM component with a custom, upgraded, or higher-value component.
Where an eligible component requires replacement, Mobi may provide for repair or replacement with an OEM, OEM-equivalent, or other reasonably appropriate component consistent with the applicable Protection Plan and applicable law.
Protection does not apply to loss or damage arising from:
an unauthorized driver;
racing or speed contests;
intentional acts;
criminal activity;
use while impaired;
unauthorized towing;
unauthorized off-road use;
commercial passenger transportation;
rideshare Period 2 and Period 3;
commercial delivery Period 2 and Period 3;;
courier activity;
use outside permitted geographic territory;
subleasing or sub-sharing;
or other prohibited use.
13.1 Rideshare
The Protection Plan does not apply to Covered Physical Damage occurring during an active Rideshare Period unless Mobi expressly states otherwise in writing.
This exclusion applies whether the Guest is:
transporting a passenger;
traveling to pick up a passenger;
13.2 Commercial Delivery
The Protection Plan does not apply to Covered Physical Damage occurring during an active Commercial Delivery Period unless Mobi expressly states otherwise in writing.
transporting an item as assigned through a commercial delivery application, employer or other service;
traveling to pick up an item as assigned through a commercial delivery application, employer or other service;;
13.3 Mixed Use
If a loss occurs during a period in which the Vehicle is being used for both an authorized Mobi Booking and an excluded commercial purpose, Mobi may evaluate whether the excluded use contributed to or caused the loss.
14.1 General Rule
Only an Authorized Driver may operate a Covered Vehicle during the Trip Period.
14.2 Damage Caused by Unauthorized Driver
Damage occurring while the Vehicle is operated by an unauthorized driver is excluded from Protection Plan benefits unless otherwise required by applicable law or expressly provided in the applicable Protection Plan.
The Guest may remain responsible for the resulting loss to the extent permitted by applicable law.
14.3 Host Authorization
A Host's permission for another individual to operate the Vehicle does not automatically make that person an Authorized Driver for purposes of the Protection Plan.
15.1 Late Return
A Guest who retains possession of the Vehicle after the Trip End Time is using the Vehicle outside the authorized Protection Period unless Mobi expressly extends the Booking.
15.2 Damage After Trip End
Damage occurring after the Trip End Time is not Covered Physical Damage under the Protection Plan unless expressly provided otherwise.
15.3 Host's Failure to Retrieve Vehicle
The Host's failure to immediately retrieve a Vehicle after the Trip End Time does not automatically extend the Protection Period.
16.1 Host Responsibility
The Host is solely responsible for determining whether participation in the Mobi Platform, peer-to-peer vehicle sharing, or the Protection Plan is permitted under any loan, lease, financing agreement, security agreement, title restriction, or other agreement applicable to the Covered Vehicle.
The Host is responsible for obtaining any consent, authorization, or approval required by a lienholder, lessor, financing company, or other person or entity having an interest in the Covered Vehicle.
16.2 No Obligation to Lienholders
Unless expressly required by applicable law or separately agreed to in writing by Mobi, Mobi has no contractual obligation to any lienholder, lessor, secured party, financing company, or other third party holding an interest in the Covered Vehicle.
The Protection Plan does not create any direct contractual relationship between Mobi and a lienholder or other interest holder.
A lienholder or other interest holder is not a beneficiary of the Protection Plan solely because it has an interest in a Covered Vehicle.
16.3 Payments to Host
Subject to these Protection Plan Terms, any Protection Plan benefit payable for Covered Physical Damage is payable to the eligible Host or other person expressly designated by Mobi.
Mobi is not responsible for satisfying any outstanding loan, lease, lien, security interest, deficiency balance, or other financial obligation associated with the Covered Vehicle.
The Host remains solely responsible for applying any payment received under the Protection Plan toward obligations owed to a lienholder, lessor, lender, or other interest holder.
16.4 Lienholder Rights
Nothing in the Protection Plan is intended to extinguish, impair, modify, or otherwise affect the independent legal rights of a lienholder or other secured party under applicable law.
The Host is responsible for ensuring that any payment received under the Protection Plan is handled in accordance with applicable financing, leasing, security, and title agreements.
16.5 Economically Impractical to Repair
In the event of a scenario where a vehicle cannot be repaired safely or it is economically impractical to repair, Mobi may require documentation concerning ownership, title, liens, financing, and other interests in the Covered Vehicle before issuing any Protection Plan payment.
Mobi may, where reasonably necessary to administer a total-loss claim, communicate with a lienholder or other interest holder regarding the Vehicle, title, salvage, or disposition of the Covered Vehicle.
Such communication does not create a contractual obligation by Mobi to the lienholder or other interest holder.
17.1 Protection Plan Is Personal and Non-Transferable
The Protection Plan is personal to the eligible Host and Covered Vehicle for which the Protection Plan was purchased or made available and is non-transferable.
No Host may sell, assign, transfer, sublicense, pledge, or otherwise convey any right to Protection Plan benefits to another person or entity without Mobi's prior written consent.
17.2 Transfer of Vehicle Ownership
A sale, transfer, gift, lease, assignment, or other change in ownership or insurable interest in the Covered Vehicle does not automatically transfer the Protection Plan to the new owner or interest holder.
The new owner or interest holder must independently satisfy Mobi's eligibility requirements and may be required to enroll in a new Protection Plan.
17.3 Transfer of Listing
A Vehicle listing may not be transferred from one Host to another for purposes of preserving Protection Plan eligibility or benefits.
A change in the person or entity listed as the Host may require Mobi's prior approval and may result in termination of the existing Protection Plan and creation of a new Protection Plan.
17.4 Assignment of Claims
Except as expressly permitted by Mobi or required by applicable law, a Host may not assign a pending or potential Protection Plan claim to another person or entity.
Any purported assignment or transfer in violation of this Section is void to the extent permitted by applicable law.
17.5 Death or Dissolution
Upon the death of an individual Host or dissolution, merger, sale, or other change in control of an entity Host, the Protection Plan does not automatically transfer to a successor, estate, beneficiary, purchaser, or other person.
Mobi may determine whether a successor is eligible to establish a new Protection Plan.
Following an accident or other loss, the Host and Guest must:
take reasonable steps to protect persons and property;
obtain emergency assistance where appropriate;
contact law enforcement when required;
promptly notify Mobi;
photograph the damage and surrounding circumstances where reasonably safe;
provide accurate information;
preserve evidence;
cooperate with the claims process;
avoid making unauthorized repairs;
avoid admitting liability on behalf of Mobi or an insurer; and
provide additional information reasonably requested to evaluate the claim.
19.1 Reporting
A claim must be reported to Mobi within 72 hours of the Trip End Period.
Failure to report promptly may affect eligibility for Protection Plan benefits to the extent permitted by applicable law and the Protection Plan.
19.2 Documentation
Mobi may require:
photographs;
repair estimates;
invoices;
police reports;
witness information;
telematics data;
vehicle-access records;
statements;
proof of ownership;
insurance information;
maintenance records; and
other reasonably necessary information.
19.3 Inspection
Mobi may require inspection of the Covered Vehicle before authorizing repairs or determining the amount of a claim.
19.4 Estimates
Mobi may use qualified repair facilities, estimating platforms, adjusters, appraisers, or other service providers to determine reasonable repair costs.
19.5 Repairs
The Host may not make material repairs for which Protection Plan benefits are requested without Mobi's prior authorization, except where necessary to prevent further damage or protect health and safety.
Mobi may evaluate a Protection Plan claim using the following sequence:
Was there an active Booking?
Was the Vehicle eligible for the Protection Plan?
Was the person operating the Vehicle an Authorized Driver?
What was the Scheduled Start Time?
What was the Trip Start Time?
What was the Trip End Time?
Did the loss occur during the Protection Period?
Was the Vehicle being used for an authorized purpose?
Did an exclusion apply?
Was the loss pre-existing?
What was the amount of Covered Physical Damage?
What deductible applies?
What amounts have been recovered from other sources?
What amount, if any, is payable under the Protection Plan?
Mobi may use reasonably reliable information to determine the Trip Start Time and Trip End Time, including:
Booking records;
digital key records;
vehicle unlock records;
GPS;
telematics;
odometer information;
photographs;
Communications;
Correspondence with rideshare or delivery claims personnel;
Host statements;
Guest statements; and
other available evidence.
Mobi's determination is subject to applicable law and any rights provided under the applicable Booking or Protection Plan.
Mobi may seek recovery from:
an at-fault third party;
another insurer;
a responsible driver;
a responsible Host;
a manufacturer;
a repair facility;
a transportation network company;
or another responsible party.
The Host agrees to cooperate with reasonable recovery efforts.
To the extent permitted by applicable law, after Mobi provides benefits under the Protection Plan, Mobi may seek recovery from a responsible third party.
The Host agrees to cooperate with such recovery efforts.
The Host must not waive or release a responsible third party from liability for a loss for which Mobi has provided Protection Plan benefits without Mobi's written consent.
Any recovery obtained from a third party relating to the same loss may be applied in accordance with applicable law and the Protection Plan.
24.1 Determination
Mobi may determine that a Covered Vehicle is economically impractical to repair when:
repair is economically impractical meaning the repair costs exceeds the acv less salvage;
the Vehicle cannot reasonably be repaired;
the Vehicle has been stolen and not recovered within the applicable period; or
another condition specified by the applicable Protection Plan applies.
24.2 Valuation
The value of a vehicle will be determined using a reasonable valuation methodology identified by Mobi or its authorized claims administrator.
24.3 Owner Retained Salvage
Mobi does not acquire, retain, purchase, take title to, or assume ownership or possession of a Shared Vehicle or its salvage following a scenario where a vehicle is impractical to repair.
The Host will retain all ownership rights, title, possession, and interest in the Shared Vehicle following an impractical repair scenario, subject to the rights of any lienholder or other party having a legal interest in the vehicle.
Because the Host retains the vehicle and any value associated with its salvage, the settlement will be reduced by the Salvage Value of the Shared Vehicle.
24.4 "Salvage Value" means the reasonably determined market value of the Shared Vehicle in its damaged condition following the loss.
Mobi may determine Salvage Value using one or more third-party salvage quotations, salvage auctions, vehicle valuation services, dismantler quotations, or other commercially reasonable sources.
Mobi may use the highest bona fide salvage offer or quotation obtained for the Shared Vehicle when determining Salvage Value.
24.5 Impractical Repair Settlement
Subject to the terms, limitations, exclusions, and applicable Host responsibility amount under the Protection Plan, the maximum vehicle payment will generally be calculated as:
Actual Cash Value less the following
– Salvage Value
– Applicable Host Responsibility/Deductible
– Prior or Unrelated Damage
– Other Applicable Adjustments
= Protection Plan Payment
The Payment, together with the value of the salvage retained by the Host, is intended to compensate the Host for the covered value of the Shared Vehicle immediately before the loss, subject to the applicable Protection Plan limits.
24.6 Responsibility for Salvage
Following an impractical repair determination, the Host is solely responsible for the Shared Vehicle and its salvage, including:
towing and transportation;
storage charges incurred after any reasonable period authorized by Mobi;
disposition, sale, repair, dismantling, or disposal of the vehicle;
obtaining possession of the vehicle from a repair facility, tow yard, storage facility, or other location;
compliance with applicable salvage-title, branding, registration, inspection, and reporting requirements;
satisfaction of any lien or other security interest; and
any taxes, fees, charges, or other expenses associated with retaining or disposing of the vehicle.
Mobi has no obligation to sell, auction, transport, store, dispose of, or otherwise take possession or control of a involved vehicle.
24.7 Mitigation and Storage
The Host must take reasonable steps to mitigate continuing expenses following notice that the Shared Vehicle may be a impractical to repair
Mobi may provide the Host with a reasonable period to remove the Shared Vehicle from a repair facility, tow yard, storage facility, or other location. Storage, towing, administrative, or other charges incurred after that reasonable period may be excluded from the claim payment.
24.8 Future Eligibility
A Shared Vehicle determined to be impractical to repair is no longer eligible to participate on the Mobi platform unless Mobi expressly determines otherwise in writing.
A vehicle with a salvage, rebuilt, reconstructed, flood, junk, branded, or similar title or vehicle-history designation is not eligible for protection unless expressly permitted by Mobi.
Protection Plan benefits may be denied or limited to the extent permitted by applicable law where a Host or Guest:
intentionally provides materially false information;
conceals material facts;
submits fraudulent documentation;
intentionally causes damage;
misrepresents the circumstances of a loss; or
otherwise engages in fraudulent conduct.
Mobi may pursue recovery of amounts paid as a result of fraud or material misrepresentation, to the extent permitted by applicable law.
The Host represents that:
the Host has authority to list the Vehicle;
the Host has an ownership or legally recognized insurable interest in the Vehicle;
the Vehicle is legally registered;
information provided to Mobi is accurate;
material pre-existing damage has been disclosed;
the Vehicle satisfies applicable eligibility requirements;
required insurance is maintained;
the Host will notify Mobi of material changes affecting eligibility;
the Host will cooperate with claims administration; and
the Host will not intentionally conceal or misrepresent a loss.
The Guest represents that:
the Guest is legally authorized to operate a motor vehicle;
information provided to Mobi is accurate;
the Guest will operate the Vehicle only during the authorized Trip Period;
the Guest will not permit an unauthorized driver to operate the Vehicle;
the Guest will not use the Vehicle for prohibited commercial purposes;
the Guest will comply with applicable law;
the Guest will promptly report accidents and damage; and
the Guest will cooperate with Mobi's claims process.
Protection Plan benefits are subject to the maximum amount specified in the applicable Protection Plan selected for the Booking.
Mobi is not responsible for amounts exceeding the applicable Protection Plan limit unless otherwise required by applicable law.
The applicable limit may be specified:
in the Booking;
in the Host's Protection Plan selection;
in the Platform; or
in a separate Protection Plan schedule incorporated into these Terms.
28.2 Maximum Ultimate Payment
Regardless of the amount of damage, repair estimates, supplements, appraisals, invoices, replacement costs, or other claimed amounts, the maximum aggregate amount Mobi will pay under the Protection Plan for any single occurrence will not exceed the lesser of:
the applicable Protection Plan Limit;
the Actual Cash Value ("ACV") of the Covered Vehicle immediately before the occurrence; or
the reasonable and necessary cost to repair the Covered Physical Damage to the extent such repairs are appropriate and economically reasonable.
The amount determined under this Section is the "Maximum Ultimate Payment."
The Maximum Ultimate Payment is further subject to all applicable deductibles, exclusions, sublimits, offsets, recoveries, and other limitations contained in these Protection Plan Terms.
28.3 Actual Cash Value
For purposes of the Protection Plan, "Actual Cash Value" or "ACV" means the reasonable market value of the Covered Vehicle immediately before the occurrence giving rise to the Covered Physical Damage.
In determining ACV, Mobi or its authorized claims administrator may consider factors including:
year, make, and model;
vehicle configuration;
factory-installed options and equipment;
mileage;
documented condition immediately before the loss;
prior damage;
documented maintenance and repair history;
geographic market;
comparable vehicle listings or transactions;
applicable market valuation data;
vehicle history information;
salvage considerations; and
other reasonably relevant factors affecting the Vehicle's market value.
ACV does not include:
sentimental or personal value;
speculative appreciation;
future appreciation;
lost income or rental revenue;
loss of use;
financing or lease charges;
outstanding loan or lease balances;
consequential economic loss; or
the value of Custom Parts, Equipment, Modifications, or Accessories that are not expressly covered under the Protection Plan.
28.4 Valuation Methodology
Mobi or its authorized claims administrator may determine ACV using a commercially reasonable vehicle valuation methodology or an independent third-party vehicle valuation service selected by Mobi.
The valuation methodology may include the use of comparable vehicles, market data, vehicle condition adjustments, mileage adjustments, geographic adjustments, factory options, and other factors reasonably relevant to determining the Vehicle's pre-loss market value.
Mobi may use different commercially reasonable valuation methodologies or valuation providers based on the circumstances of a particular claim, Vehicle, geographic market, or type of loss.
No particular valuation provider, database, valuation methodology, or comparable vehicle source is guaranteed unless expressly stated in the applicable Protection Plan.
28.5 Repairable Vehicle
If the Covered Vehicle is repairable, Mobi's obligation under the Protection Plan will not exceed the lesser of:
the reasonable and necessary cost to repair the Covered Physical Damage;
the applicable Protection Plan Limit; or
the ACV of the Covered Vehicle immediately before the loss.
Mobi is not obligated to authorize repairs where the reasonable cost of repairing the Covered Vehicle would exceed its ACV, subject to applicable law.
The submission, approval, or payment of an initial repair estimate does not establish that subsequent supplements or additional expenses will be covered.
All supplements remain subject to these Protection Plan Terms and the Maximum Ultimate Payment.
28.6 Vehicle impractical to Repair
If Mobi or its authorized claims administrator determines that the Covered Vehicle is a not economically practical to repair, the Maximum Ultimate Payment will not exceed the lesser of:
the ACV of the Covered Vehicle immediately before the loss; or
the applicable Protection Plan Limit.
The applicable deductible, other recoveries, exclusions, and other limitations will then be applied in determining the final amount payable.
A Vehicle may be determined to be economically impractical to repair where the reasonable cost to repair the Covered Vehicle, together with other reasonably anticipated costs associated with the loss, is equal to or exceeds the Vehicle's ACV, or where the Vehicle otherwise meets Mobi's applicable total-loss criteria.
28.6.1 Net ACV Value and Payout when vehicle is Economically Impractical to Repair
For a Covered Vehicle determined to be economically impractical to repair, Mobi may determine the Net Vehicle ACV settlement by deducting the reasonably obtainable net salvage recovery from the Actual Cash Value of the Covered Vehicle immediately before the loss.
For purposes of this Section:
Net Vehicle ACV settlement = ACV − Deductible - Net Salvage Recovery
"Net Salvage Recovery" means the amount reasonably expected to be recovered from the sale, disposition, or other realization of the Covered Vehicle's salvage, less reasonable and necessary costs directly associated with obtaining that recovery, including applicable towing, storage, transportation, auction, title, and salvage-processing expenses.
Subject to applicable law and the terms of the Protection Plan, the Net Value represents the lowest ultimate economic cost to Mobi of resolving a total-loss claim while retaining or otherwise realizing the value of the Covered Vehicle's salvage.
Mobi may therefore elect to:
pay the Host the applicable Net Vehicle ACV settlement and retain or obtain the salvage interest in the Covered Vehicle;
pay the applicable ACV, subject to obtaining the salvage value or other recovery attributable to the Covered Vehicle; or
resolve the loss through another commercially reasonable disposition method that does not result in Mobi paying more than the applicable Maximum Ultimate Payment.
28.6.2 Salvage Recovery
Where Mobi provides a total-loss or theft payment and obtains or retains an interest in the salvage at its discretion, Mobi may dispose of the Covered Vehicle through a salvage auction, sale, transfer, or other commercially reasonable method.
The expected or actual salvage recovery may be considered in determining the amount payable under the Protection Plan, subject to applicable law.
Mobi may use a commercially reasonable salvage valuation methodology or third-party salvage provider to establish the expected salvage recovery.
28.6.3 Salvage Costs
Reasonable and necessary costs incurred to obtain the salvage recovery may be deducted from the gross salvage value in determining Net Salvage Recovery.
Mobi will not be required to credit the Host with gross salvage proceeds that are not actually or reasonably obtainable after consideration of applicable salvage-related expenses.
28.6.4 Host Retention of Salvage
If the Host elects or is permitted to retain the salvage, the amount payable under the Protection Plan may be reduced by the reasonably determined salvage value retained by the Host, subject to applicable law.
The Host may also be responsible for all costs associated with retaining, transporting, storing, repairing, retitling, registering, or otherwise disposing of the salvage.
28.7 No Guaranteed Repair or Replacement Value
The Protection Plan does not provide guaranteed replacement cost, replacement-value coverage, or any other guarantee that the Host will receive sufficient funds to purchase a replacement vehicle of the same make, model, age, mileage, or configuration.
The Protection Plan is limited to the benefits expressly provided under these Protection Plan Terms.
Nothing in these Protection Plan Terms is intended to waive, limit, or eliminate any right or protection that cannot lawfully be waived or limited.
Where applicable law requires a different treatment of a loss, that requirement will govern to the extent necessary.
Certain states may impose requirements concerning:
peer-to-peer vehicle sharing;
insurance;
physical damage protection;
disclosures;
consumer protection;
claims handling;
cancellation;
indemnification; or
other matters.
Mobi may provide state-specific Protection Plan terms or addenda.
Where a state-specific provision conflicts with these general Protection Plan Terms, the state-specific provision controls to the extent required by law.
Mobi may modify the Protection Plan for future Bookings by providing notice through the Platform or other permitted means.
Changes will not retroactively alter the terms applicable to a completed Booking except where permitted by law.
The Protection Plan applicable to a particular Booking will be the version identified or incorporated into that Booking.
By listing a Vehicle on Mobi or selecting or accepting a Protection Plan, the Host acknowledges that:
the Protection Plan is contractual protection and is not insurance;
the Host must maintain qualifying underlying physical damage insurance;
the Protection Plan does not replace required insurance;
the Host must have an ownership or legally recognized insurable interest in the Covered Vehicle to receive Protection Plan compensation;
the Protection Plan is non-transferable;
Protection generally begins at the Trip Start Time;
Protection generally ends at the Trip End Time;
Delivery Periods are outside the Protection Period unless expressly covered;
Rideshare and Commercial Delivery use are excluded in Period 2 and Period 3 scenarios;
only Authorized Drivers may operate the Vehicle;
deductibles and other Host responsibilities apply;
exclusions and limits apply;
Mobi may investigate and determine claims under these Terms;
Mobi has no contractual obligation to a lienholder unless otherwise required by applicable law or separately agreed in writing; and
the Host must cooperate with Mobi and applicable insurers in connection with a loss.
These Protection Plan Terms, together with the applicable Booking, Protection Plan selection, state-specific terms, and other documents expressly incorporated by reference, constitute the agreement governing the Protection Plan.
The Protection Plan is separate from any applicable motor vehicle insurance policy.
Nothing in these Protection Plan Terms modifies or replaces an applicable insurance policy.
